Bộ Xây dựng sắp ban hành 2 văn bản tác động rất lớn đến thị trường BĐS

Trước thực trạng nguồn cung bất động sản (BĐS) bị ảnh hưởng bởi thủ tục pháp lý, đại diện Bộ Xây dựng tiết lộ nhiều văn bản quan trọng góp phần tháo gỡ vấn đề này sắp được ban hành.

Thủ tục pháp lý ảnh hưởng nguồn cung BĐS

Tại hội thảo “Bất động sản Việt Nam, bình thường mới, nhu cầu mới, xu thế mới”, chuyên gia kinh tế Võ Trí Thành, Viện trưởng Viện Nghiên cứu Chiến lược Thương hiệu và Cạnh tranh nhận định, hai năm qua, cùng với nhiều quốc gia trên thế giới thì Việt Nam là một trong những điểm sáng về BĐS. Nếu quan sát có thể thấy trong giai đoạn dịch không phải tỉnh nào cũng tăng trưởng âm. Điển hình như Vĩnh Phúc, Hải Phòng vẫn tăng trưởng 14%. Do đó đầu tư BĐS vẫn còn nhiều kỳ vọng mặc dù các vấn đề về pháp lý, đất đai, luật kinh doanh BĐS còn nhiều vấn đề cần phải bổ sung, chỉnh sửa.

Đồng quan điểm với ông Thành, chuyên gia kinh tế Đặng Hùng Võ cho biết, từ trước khi COVID – 19 bùng phát, thị trường BĐS đã “trục trặc” về khung pháp lý. Đầu tiên là khung pháp lý cho BĐS du lịch, nghỉ dưỡng chưa ổn. Thứ hai là vấn đề về Luật Đất đai chưa được giải quyết. Ngoài ra, ông Võ cho rằng cần chú trọng yếu tố thông tin bởi nếu không có thông tin, các nhà đầu tư không thể dự báo để bắt tay vào phát triển.

Trong khi đó, ông Nguyễn Mạnh Khởi, Phó cục trưởng Cục Quản lý Nhà và Thị trường BĐS (Bộ Xây dựng) cho biết, mặc dù thị trường chịu ảnh hưởng của COVID -19 nhưng giao dịch BĐS trong 6 tháng đầu năm 2021 vẫn khá tốt, khi có 55.000 giao dịch trên cả nước, cùng kỳ năm 2020 có 43.000 giao dịch. Mức độ quan tâm của thị trường với BĐS vẫn khá cao. Một số phân khúc, loại hình BĐS vẫn tăng giá.

Tuy nhiên, vài năm gần đây, trong số gần 5.000 dự án BĐS được triển khai. Bên cạnh những dự án hoàn thành thì còn hàng nghìn dự án đang triển khai, trong số đó có nhiều dự án gặp vấn đề liên quan đến thủ tục pháp lý và thời gian chờ giải quyết rất lâu. Bất cập này khiến cho việc phát triển các dự án mới gặp không ít khó khăn.

Nhiều văn bản quan trọng sắp được ban hành

Để giải quyết vấn đề vừa nêu, ông Nguyễn Mạnh Khởi cho biết Bộ Xây dựng đang cùng với các bộ, ngành khác tìm cách tháo gỡ bằng việc sửa Luật Đầu tư 2020 và Luật Xây dựng.

Theo đó, trong năm 2021 sẽ ban hành Nghị định hướng dẫn Luật Kinh doanh BĐS và Nghị định về hệ thống thông tin thị trường BĐS. “Chúng tôi dự báo 2 văn bản này sẽ tác động rất lớn đến thị trường”, Phó cục trưởng Cục Quản lý Nhà và Thị trường BĐS nhận định.

Ông Khởi cũng chia sẻ thêm, Bộ Xây dựng đang đề xuất chỉnh sửa Luật Kinh doanh BĐS và Luật Nhà ở cho phù hợp với Luật Đất đai mới, phù hợp với chương trình của Quốc hội. Bởi trong năm tới sẽ sửa Luật Đất đai.

Song song với đó, Chính phủ cũng đang chuẩn bị trình Quốc hội thông qua một luật và sửa 10 luật, để tiếp tục tháo gỡ khó khăn cho các nhà đầu tư và dự án. Do đó, Phó cục trưởng Cục Quản lý Nhà và Thị trường BĐS dự báo thị trường sẽ phát triển khởi sắc hơn sau khi vấn đề pháp lý được hoàn thiện.


Các văn bản sắp ban hành hứa hẹn tháo gỡ nhiều nút thắt về thủ tục pháp lý, giúp thị trường BĐS khởi sắc hơn.

Nói thêm về vấn đề pháp lý của BĐS, TS. Cấn Văn Lực, chuyên gia kinh tế cho rằng nếu vấn đề này được giải quyết, nguồn cung trên thị trường sẽ tăng nhanh, thị trường BĐS vốn đang tốt sẽ ngày càng tốt hơn.

Ông Lực dẫn chứng trong 9 tháng đầu năm, cho vay nhà ở của hệ thống ngân hàng tăng rất tốt, khoảng 9-10%, dư nợ khoảng 1,2 triệu tỷ đồng, trong đó cho vay kinh doanh đầu tư BĐS là 700.000 tỷ đồng. Hết 9 tháng, có khoảng 1.000 doanh nghiệp BĐS trở lại làm việc và khoảng 5.400 doanh nghiệp kinh doanh BĐS thành lập mới, số này đăng ký vốn khoảng 343.000 tỷ đồng, góp phần tạo ra 35.000 việc làm.
