Cựu Chủ tịch HĐQT VEAM tiếp tục bị khởi tố về sai phạm quản lý và sử dụng tài sản Nhà nước

Cơ quan Cảnh sát điều tra Bộ Công an (C03) đang thụ lý điều tra các vụ việc có dấu hiệu sai phạm tại Tổng Công ty Máy động lực và Máy nông nghiệp Việt Nam (VEAM) và các đơn vị thành viên.

Căn cứ kết quả điều tra, làm rõ dấu hiệu sai phạm tại các dự án sử dụng đất, Cơ quan Cảnh sát điều tra Bộ Công an xác định: Lâm Chí Quang, nguyên Chủ tịch Hội đồng quản trị VEAM; Nguyễn Thanh Giang, nguyên Tổng Giám đốc VEAM; Đào Huấn Ngữ, nguyên Giám đốc Công ty Đúc số 1.

Các đối tượng trên đã có hành vi vi phạm pháp luật trong việc quản lý, sử dụng khu đất diện tích 8,930.9 m2 tại địa chỉ số 220 đường Bình Thới, phường 14, quận 11, Thành phố Hồ Chí Minh, gây thiệt hại đặc biệt nghiêm trọng tài sản của Nhà nước.

Ngày 14/02/2022, Cơ quan Cảnh sát điều tra Bộ Công an ra Quyết định khởi tố vụ án hình sự, khởi tố bị can và áp dụng biện pháp ngăn chặn đối với 03 đối tượng trên cùng về tội Vi phạm quy định về quản lý, sử dụng tài sản Nhà nước gây thất thoát, lãng phí theo Điều 219 Bộ luật Hình sự năm 2015.

Sau khi Viện kiểm sát nhân dân tối cao (Vụ 3) phê chuẩn, Cơ quan Cảnh sát điều tra Bộ Công an đã thi hành các Quyết định, Lệnh nêu trên theo đúng quy định pháp luật.

Hiện Cơ quan Cảnh sát điều tra Bộ Công an đang tập trung điều tra mở rộng vụ án và áp dụng các biện pháp theo luật định để thu hồi tài sản thất thoát cho Nhà nước.


Bị can Lâm Chí Quang

Trước đó, bị can Lâm Chí Quang cùng hàng chục người khác là nguyên lãnh đạo của VEAM đã bị C03 khởi tố trong vụ án khác vì có nhiều quyết định, chủ trương đầu tư trái quy định gây thiệt hại tài sản của Nhà nước hàng trăm tỷ đồng. Theo tài liệu của cơ quan điều tra, từ năm 2007 đến 2013, VEAM đã có 6 lần bảo lãnh cho Vetranco, một công ty con của VEAM, vay tiền tại các ngân hàng, ký hợp đồng thương mại và cho Vetranco vay tiền theo hạn mức trái quy định để ký các hợp đồng kinh doanh mua bán hàng hóa.

Tổng giám đốc của VEAM qua các thời kỳ (2011 – 2013) đã không thực hiện theo quy trình có sự tham mưu của các bộ phận chuyên môn, ký nhiều văn bản bảo lãnh thanh toán cho các hợp đồng tín dụng Vetranco vay tiền tại các ngân hàng.

Sau đó do Vetranco không trả được các khoản vay nên VEAM buộc phải dùng nguồn tiền của chính tổng công ty trả cho các ngân hàng. Cơ quan điều tra kết luận những hành vi này đã gây thiệt hại cho VEAM 208 tỷ đồng.

Cơ quan điều tra xác định, từ các nguồn vốn vay của VEAM, vốn vay ngân hàng và vốn tự có, Vetranco đã lập các hợp đồng khống mua bán hàng hóa lòng vòng, chuyển tiền cho các doanh nghiệp vay trái quy định, gây thiệt hại tài sản Nhà nước gần 182 tỷ đồng…

Mới đây, cơ quan điều tra cũng khởi tố bị can, ra lệnh bắt tạm giam đối với Nguyễn Đức Toàn, Phó giám đốc Nhà máy ôtô VEAM và Trần Đại Lợi, nguyên Giám đốc Nhà máy ôtô VEAM. Bị can Lợi đang bỏ trốn nên C03 đã ra quyết định truy nã toàn quốc.


Trước đó, ngày 6/10, C03 đã ban hành kết luận điều tra bổ sung, chuyển hồ sơ sang Viện KSND Tối cao đề nghị truy tố thêm 11 bị can trong vụ án “Vi phạm quy định về quản lý, sử dụng tài sản nhà nước gây thất thoát, lãng phí” xảy ra tại Tổng công ty Máy động lực và máy nông nghiệp Việt Nam (VEAM) và một số doanh nghiệp liên quan.

Cụ thể, C03 đã chuyển hồ sơ sang Viện KSND tối cao, giữ nguyên quan điểm đề nghị truy tố các bị can Trần Ngọc Hà – cựu Chủ tịch HĐQT, cựu Tổng Giám đốc (TGĐ) VEAM; Lâm Chí Quang – cựu TGĐ VEAM; Vũ Quang Tâm và Vũ Từ Công – đều là cựu Phó TGĐ VEAM; Nguyễn Mạnh Chung – Giám đốc Công ty TNHH Máy kéo nông nghiệp…
