Đất công ‘biến’ thành dự án nhà ở không qua đấu giá

Nhiều dự án vốn là đất công, sau nhiều giai đoạn lại được “biến hóa” thành các dự án nhà ở thương mại không qua đấu giá đang diễn ra tại Hà Nội.

Dự án nhà ở cao tầng kết hợp dịch vụ thương mại – Summit Building tại số 216 Trần Duy Hưng

Theo tìm hiểu của phóng viên, tại Dự án nhà ở cao tầng kết hợp dịch vụ thương mại – Summit Building tại số 216 Trần Duy Hưng, Cầu Giấy, Hà Nội do Cty CP Veracity làm chủ đầu tư. Ngày 27/1/2003, UBND thành phố Hà Nội ban hành quyết định cho Cty TNHH Hoa Phượng Thăng Long (Cty Hoa Phượng Thăng Long) thuê 4.741m2 tại phường Trung Hòa, quận Cầu Giấy. Mục đích thuê đất là xây dựng văn phòng làm việc và trung tâm giới thiệu sản phẩm. Thời gian thuê đất 45 năm kể từ ngày ký quyết định trên (đến năm 2048).

Theo quyết định trên, trong tổng diện tích 4.741m2 có 2.438m2 đất do UBND quận Cầu Giấy quản lý; 38m2 đất là diện tích làm đường nội bộ thuộc khu di dân Tràng Hào do Ban Quản lý dự án Thăng Long quản lý; 2.265m2 đất do UBND phường Trung Hòa quản lý và một số hộ dân đang sử dụng.

Đến năm 2014, một pháp nhân mới là Cty TNHH Hoa phượng Thăng Long Hà Nội (Hoa Phượng Thăng Long Hà Nội) ra đời, cũng có địa chỉ tại 216 Trần Duy Hưng. Chưa đầy 4 tháng sau, Hoa Phượng Thăng Long đã chuyển nhượng một phần dự án cho Hoa phượng Thăng Long Hà Nội.

Ngày 15/2/2017, UBND thành phố Hà Nội có Quyết định 1147/QĐ-UBND cho phép Hoa Phượng Thăng Long Hà Nội chuyển mục đích sử dụng 2.373m2 đất tại thửa B khu 216 Trần Duy Hưng để thực hiện dự án đầu tư xây dựng Nhà ở cao tầng kết hợp dịch vụ thương mại – Summit Building. Quyết định này dựa trên các Nghị định của Chính phủ về thu hồi đất, giao đất, chuyển mục đích sử dụng đất để thực hiện các dự án đầu tư trên địa bàn thành phố và đề nghị của Giám đốc Sở TN&MT Hà Nội.

Như vậy, sau gần 3 năm được cho thuê đất nhưng không triển khai theo mục tiêu ban đầu là thực hiện một phần dự án đầu tư xây dựng văn phòng làm việc và trung tâm giới thiệu sản phẩm, Hoa Phượng Thăng Long Hà Nội lại được chấp thuận hợp tác cùng một doanh nghiệp tư nhân khác, để đầu tư xây dựng chung cư thương mại mà không thông qua đấu giá.

Tương tự, dự án Tổ hợp nhà ở, văn phòng và dịch vụ thương mại (Phương Đông Green Park), số 1 Trần Thủ Độ, Hoàng Mai do Cty TNHH MTV đầu tư Phương Đông làm chủ đầu tư. Tiền thân của dự án là Tổ hợp nhà ở, văn phòng và dịch vụ thương mại do Tổng Cty Xây dựng nông nghiệp và phát triển nông thôn – Cty TNHH MTV (100% vốn nhà nước) làm chủ đầu tư, được thành phố Hà Nội cấp Giấy chứng nhận đầu tư năm 2011.

Sau thời gian bỏ bẵng, tháng 8/2017, UBND thành phố Hà Nội Quyết định thu hồi toàn bộ 4.346,6 m2 đất tại dự án này giao cho Cty TNHH MTV Đầu tư Phương Đông thuê để làm trụ sở, văn phòng làm việc với lý do, Tổng Cty Xây dựng nông nghiệp Việt Nam (lúc này đã cổ phần hoá) đã góp vốn bằng toàn bộ tài sản để xây dựng trụ sở, văn phòng làm việc.

Hơn 1 năm sau (tháng 10/2018), thành phố Hà nội lại ban hành Quyết định điều chỉnh chủ trương đầu tư, giao Cty TNHH MTV Đầu tư Phương Đông làm nhà đầu tư thực hiện dự án Tổ hợp nhà ở, văn phòng và dịch vụ thương mại với 936 căn chung cư, 13 căn nhà ở thấp tầng, 312 căn cho thuê ngắn hạn.

Để hiện thực hoá chủ trương trên, tháng 7/2019, Phó Chủ tịch UBND thành phố Hà Nội Nguyễn Quốc Hùng ký ban hành Quyết định cho phép Cty TNHH MTV Đầu tư Phương Đông chuyển toàn bộ mục đích sử dụng đất trên sang thực hiện dự án Tổ hợp nhà ở, văn phòng và dịch vụ thương mại.

Gây áp lực dân số

KTS Đào Ngọc Nghiêm, nguyên Giám đốc Sở Quy hoạch Kiến trúc Hà Nội nhận định, hiện tượng điều chỉnh từ đất cho thuê xây dựng văn phòng làm việc thành nhà chung cư cao tầng đang gây áp lực không nhỏ đến hạ tầng giao thông, hạ tầng xã hội, phá vỡ quy hoạch Thủ đô.

Có một nghịch lý tại Hà Nội là càng định hướng giảm thì dân số lại càng tăng do cho phép chuyển đổi mục đích sử dụng đất, xây chung cư cao tầng kéo dân vào nội đô. Dân số tăng tác động đến hạ tầng giao thông, xã hội gây tắc đường, thiếu lớp học, ô nhiễm môi trường, rác thải… Tất cả đều là tác động của dân số.
