Báo cáo tổng hợp kết quả kiểm toán năm 2020 của Kiểm toán Nhà nước vừa ban hành cho thấy, nhiều dự án nhà ở xã hội tại TP.HCM, Hà Nội bán sai đối tượng.

Theo đó, tại 5 dự án được kiểm toán chi tiết ở TP.HCM có 85 trường hợp người được mua, thuê nhà ở xã hội có dấu hiệu đã có nhà ở; 64 trường hợp người được mua, thuê nhà ở xã hội có giao dịch ủy quyền về nhà ở xã hội. Trong khi đó, tại 2 dự án ở Hà Nội được kiểm toán chi tiết có 122 khách hàng được mua, 16 khách hàng được thuê nhà ở xã hội sử dụng không đúng mục đích.

Kiểm toán cũng chỉ ra, một số dự án tại TP.HCM được hoán đổi 20% diện tích đất để phát triển nhà ở xã hội bằng một khu đất khác không có trong quy định như khu dân cư và công viên Phước Thiện, khu dân cư Hoàng Nam ở phường An Lạc quận Bình Tân.

Kiểm toán Nhà nước cũng nêu rõ, việc lập, thẩm tra, phê duyệt dự toán chưa chính xác về khối lượng, đơn giá, chưa xác định rõ diện tích chung, riêng, phương án tài chính còn sai sót làm ảnh hưởng giá bán, cho thuê.

Tại TP.HCM, Kiểm toán Nhà nước kiến nghị các chủ đầu tư giảm giá trị dự toán 83 tỉ đồng đối với 5 dự án được kiểm toán chi tiết. Hà Nội cũng phải giảm chi phí quyết toán dự án đầu tư 5,2 tỉ đồng; giảm chi phí đầu tư trong phương án tính giá bán, cho thuê 17,2 tỉ đồng; yêu cầu chủ đầu tư kiểm tra, xác định khi quyết toán dự án 1,2 tỉ đồng đối với 3 dự án được kiểm toán chi tiết. Đồng thời kiến nghị một số chủ đầu tư xác định lại chi phí đầu tư khi quyết toán các dự án đảm bảo chính xác, phù hợp với quy định làm cơ sở để xác định giá bán, cho thuê, thuê mua nhà ở xã hội.

Kết quả kiểm toán còn cho thấy một số tồn tại, bất cập về cơ chế, chính sách như chính sách ưu đãi về thuế giá trị gia tăng, thuế thu nhập doanh nghiệp đối với các dự án nhà ở xã hội.

Đó là cơ chế ưu đãi về thuế giá trị gia tăng, thuế thu nhập doanh nghiệp đối với các dự án nhà ở xã hội theo quy định tại khoản 2 Điều 9 Nghị định 100/2015/NĐ-CP còn chưa thống nhất với luật Thuế giá trị gia tăng, luật Thuế thu nhập doanh nghiệp.

Kiểm toán Nhà nước cũng khẳng định, việc cho phép nộp bằng tiền thay cho việc bắt buộc dành quỹ đất 20% phát triển nhà ở xã hội đối với các dự án có quy mô sử dụng đất dưới 10 ha là không phù hợp với quy định của khoản 2 Điều 16 luật Nhà ở năm 2014 và khoản 1 Điều 118 luật Đất đai năm 2013.

Trong khi đó, TP.HCM và Hà Nội chưa có hướng dẫn, quản lý, đôn đốc các chủ đầu tư thực hiện nghĩa vụ nộp số tiền tương đương với giá trị quỹ đất 20% vào ngân sách địa phương để đầu tư xây dựng nhà ở xã hội.

Kiểm toán Nhà nước cũng đã phát hiện ra 3 dự án nhà ở xã hội trên địa bàn Hà Nội chuyển sang dự án nhà ở thương mại trái quy định. Hầu hết các dự án nhà ở xã hội trên địa bàn Hà Nội trong kế hoạch kiểm tra đều “ôm” đất chậm triển khai.
