Kết luận thanh tra ‘siêu’ dự án tại sân bay Nha Trang: Kiến nghị xử lý nghiêm

Thanh tra Chính phủ công bố thông báo kết luận thanh tra về việc chấp hành chính sách, pháp luật liên quan các dự án sử dụng quỹ đất thanh toán tại khu vực sân bay Nha Trang (TP.Nha Trang, Khánh Hòa).

Thủ tướng chỉ đạo Chủ tịch và các Phó chủ tịch UBND tỉnh Khánh Hòa (giai đoạn 2014 – 2019) nghiêm túc kiểm điểm, đề xuất hình thức xử lý nghiêm minh.

Chiều 30.6, Thanh tra Chính phủ (TTCP) công bố thông báo kết luận thanh tra (KLTT) về việc chấp hành chính sách, pháp luật liên quan các dự án sử dụng quỹ đất thanh toán tại khu vực sân bay Nha Trang (TP.Nha Trang, Khánh Hòa). KLTT lần này liên quan các dự án (DA) BT (xây dựng – chuyển giao), có chủ trương sử dụng quỹ đất thanh toán tại khu vực sân bay Nha Trang. Trong đó, 3 DA do Công ty CP Tập đoàn Phúc Sơn (Tập đoàn Phúc Sơn) là nhà đầu tư (NĐT).

Giao đất trước, ký hợp đồng BT sau

Theo hồ sơ, tháng 10.2015, Tập đoàn Phúc Sơn được cấp giấy chứng nhận đầu tư các DA tại sân bay Nha Trang (cũ).

Năm 2016, UBND tỉnh Khánh Hòa phê duyệt quy hoạch chi tiết Khu trung tâm đô thị thương mại – dịch vụ – tài chính – du lịch Nha Trang (TTTM-TCDL Nha Trang), giao Tập đoàn Phúc Sơn làm chủ DA. Tháng 6.2016, UBND tỉnh Khánh Hòa có tờ trình gửi trung ương xin chủ trương lấy đất sân bay thanh toán cho các hợp đồng BT; đồng thời xin chủ trương lựa chọn NĐT trong trường hợp đặc biệt theo điều 26 luật Đấu thầu vì lý do “cấp bách”. Chủ trương này được Thủ tướng đồng ý về nguyên tắc và cho phép thực hiện. Tháng 10.2016, tỉnh Khánh Hòa quyết định giao cho Tập đoàn Phúc Sơn hơn 62 ha tại TTTM-TCDL Nha Trang.

Để hợp thức hóa hơn 62 ha đất trên, năm 2017 và 2018, tỉnh Khánh Hòa ký hợp đồng BT với Tập đoàn Phúc Sơn thực hiện 3 DA BT, gồm: DA các tuyến đường, các nút giao thông kết nối với khu sân bay Nha Trang, tổng mức đầu tư dự kiến 725,3 tỉ đồng; DA nút giao thông Ngọc Hội tổng mức đầu tư dự kiến 1.378,9 tỉ đồng; DA đường vành đai kết nối nút giao thông Ngọc Hội tổng mức đầu tư dự kiến 1.180,1 tỉ đồng.

Để hoàn vốn các DA trên, tỉnh Khánh Hòa sẽ giao một phần quỹ đất tại DA TTTM-TCDL Nha Trang cho Phúc Sơn. Theo Bộ KH-ĐT, dù được Chính phủ cho phép lựa chọn NĐT trong trường hợp đặc biệt, nhưng quy trình thực hiện các DA BT của Khánh Hòa chưa tuân thủ đầy đủ ý kiến chỉ đạo của Thủ tướng. Các quyết định tháng 10.2016 và tháng 7.2017 của tỉnh Khánh Hòa có nội dung “giao toàn bộ diện tích hơn 62 ha đất cho Tập đoàn Phúc Sơn để sử dụng đất thực hiện DA”. Tuy nhiên, các quyết định giao đất này đều được thực hiện trước khi hợp đồng BT được ký kết.

Hàng loạt sai phạm

Theo KLTT, 3 DA do Tập đoàn Phúc Sơn làm NĐT, có những tồn tại, vi phạm. Cụ thể, các DA BT không hoàn thành đưa vào khai thác, sử dụng vào cuối năm 2017, mặc dù đã gia hạn đến tháng 6.2021 nhưng đến thời điểm thanh tra mới thi công đạt khoảng 27% khối lượng xây lắp. Phê duyệt đề xuất DA, báo cáo nghiên cứu khả thi, tổng mức đầu tư, ký hợp đồng BT không phù hợp với tờ trình báo cáo Thủ tướng, làm tăng tổng mức đầu tư lên 484 tỉ đồng, kéo dài thời gian thực hiện DA lên thêm 30 tháng.

Việc lập, thẩm định, phê duyệt báo cáo nghiên cứu khả thi, ký kết hợp đồng BT còn có một số sai sót trong áp dụng định mức, đơn giá, biện pháp thi công, đền bù giải phóng mặt bằng và đưa một số hạng mục vào DA đầu tư chưa đúng quy định, làm tăng tổng mức đầu tư 3 DA lên 499,202 tỉ đồng. Phê duyệt kết quả lựa chọn NĐT, đàm phán và ký kết hợp đồng 3 DA BT có giá trị hợp đồng BT cao hơn giá trị DA BT được tỉnh phê duyệt trong kế hoạch lựa chọn NĐT là: 73,49 tỉ đồng, là vi phạm về nguyên tắc xét duyệt trúng thầu…


Xác định lại thời điểm tính giá đất để truy thu

Về tài chính, theo KLTT, tỉnh Khánh Hòa khẩn trương chỉ đạo chấn chỉnh, xử lý khắc phục những tồn tại, vi phạm đối với 3 hợp đồng BT do Tập đoàn Phúc Sơn là NĐT. Cần ban hành quyết định bổ sung giao đất, cho thuê đất để có đầy đủ cơ sở pháp lý cho việc thanh, quyết toán các DA BT; xử lý diện tích đất còn lại. Sớm ban hành quyết định giảm tổng mức đầu tư 499,202 tỉ đồng tại các DA BT nói trên; đồng thời, nghiêm túc kiểm điểm các đơn vị có liên quan trong việc thẩm định 3 DA này.

Bên cạnh đó, địa phương sớm xác định giá thu tiền sử dụng đất để thanh toán hợp đồng BT. UBND tỉnh Khánh Hòa khẩn trương xác định thời điểm tính giá đất để thanh toán hợp đồng BT đúng quy định của pháp luật, đảm bảo khắc phục tồn tại, vướng mắc, vừa bảo đảm quyền lợi chính đáng, hợp pháp của NĐT; không để thất thoát tài sản của nhà nước.

Cũng theo KLTT, tỉnh Khánh Hòa bàn giao đất cho Tập đoàn Phúc Sơn tháng 12.2015, khi chưa có quyết định thu hồi đất, giao đất, cho thuê đất là không đúng quy định. Tỉnh ban hành Quyết định 3262/QĐ-UBND ngày 28.10.2016, không có văn bản thẩm định nhu cầu sử dụng đất, điều kiện giao đất của Sở TN-MT là vi phạm quy định.

Trong đó, có nội dung giao đất, cho thuê đất có thu tiền sử dụng đất để Tập đoàn Phúc Sơn thực hiện DA TTTM-TCDL là không đúng với đề xuất của UBND tỉnh (sử dụng quỹ đất để thanh toán hợp đồng BT) được Thủ tướng chấp thuận ngày 6.7.2016. Sau khi hợp đồng BT được ký kết, năm 2018, tỉnh Khánh Hòa ban hành quyết định điều chỉnh, bổ sung Quyết định 2139/QĐ-UBND, nhưng chưa thể hiện đầy đủ nội dung giao đất, cho thuê đất để thanh toán các DA BT. Đến thời điểm thanh tra, địa phương chưa xác định giá đất cụ thể để làm cơ sở xác định giá trị quỹ đất hoàn vốn cho các DA BT; chưa có quyết định phê duyệt giá đất…

Trách nhiệm thuộc về các lãnh đạo

TTCP kết luận trách nhiệm để xảy ra những vi phạm nêu trên của 3 DA BT thuộc về UBND tỉnh Khánh Hòa, giám đốc các sở KH-ĐT, Xây dựng, TN-MT, Tài chính, một số ban quản lý và Tập đoàn Phúc Sơn…

Từ đó, TTCP kiến nghị Thủ tướng chỉ đạo Chủ tịch và các Phó chủ tịch UBND tỉnh Khánh Hòa (giai đoạn 2014 – 2019) nghiêm túc kiểm điểm, đề xuất hình thức xử lý nghiêm minh. Đồng thời giao Chủ tịch UBND tỉnh Khánh Hòa chỉ đạo giám đốc các sở: TN-MT, Xây dựng, KH-ĐT, UBND TP.Nha Trang, Văn phòng UBND tỉnh, giám đốc các ban quản lý dự án có liên quan nghiêm túc kiểm điểm và đề xuất cấp có thẩm quyền xử lý nghiêm minh các tập thể và cá nhân có liên quan đã để xảy ra các sai phạm đã nêu. Sớm chấn chỉnh kịp thời công tác quản lý đất đai, quản lý đầu tư xây dựng, nhất là đối với các công trình DA thực hiện theo hình thức BT.
