Ồ ạt san núi làm dự án ở Nha Trang: Những dấu hiệu bất thường
Thay vì xem xét cẩn trọng hơn trong việc cấp phép các dự án trên núi ở Nha Trang thì thời gian qua tỉnh Khánh Hòa lại ồ ạt cho phép nhiều doanh nghiệp triển khai san núi phân lô bán nền, bất chấp quy hoạch.
Núi Cô Tiên ở P.Vĩnh Hòa (TP.Nha Trang) được biết đến là ngọn núi đẹp với vị trí đắc địa, có một mặt hướng thẳng ra vịnh Nha Trang – vốn là 1 trong 29 vịnh đẹp nhất hành tinh. Từ xưa đến nay, núi này còn có chức năng điều tiết hệ sinh thái, chống sạt lở, phòng hộ và được xem là biểu tượng của TP.Nha Trang về cảnh quan. Thế nhưng, thay vì giữ nguyên vẹn vẻ đẹp hoang sơ vốn có, vì lợi nhuận đem lại từ việc phân lô bán nền, nhiều doanh nghiệp đã nhảy vào đây xẻ núi làm biệt thự.
Cấp phép tràn lan
Theo thống kê, núi Cô Tiên hiện có gần 30 dự án bất động sản (BĐS) phân lô bán nền, biệt thự, khu du lịch sinh thái… đã được thỏa thuận đầu tư. Trên thực tế, một số dự án đã xẻ núi, san nền phân lô tràn lan khiến núi bị biến dạng. Trong số các dự án trên núi Cô Tiên phải kể đến dự án biệt thự của Công ty TNHH Tâm Hương (TP.Nha Trang).
Cuối năm 2019, nhiều biệt thự của Công ty Tâm Hương triển khai đồng loạt, khiến cử tri TP.Nha Trang nhiều lần lên tiếng phản ánh tình trạng xây trái phép. Sau đó (từ khoảng tháng 11.2019 đến đầu năm 2020), nhiều cơ quan chức năng địa phương, trong đó có Sở Xây dựng tỉnh Khánh Hòa, đã kiểm tra, phát hiện nhiều biệt thự đang xây dở dang, chủ yếu đang làm phần thô công trình nên yêu cầu dừng mọi hoạt động xây dựng tại đây. Tuy nhiên, không hiểu vì sao đến nay các công trình đó đã hoàn thành đưa vào sử dụng dù lệnh cấm đã ban hành trước đó (!?).
Theo UBND tỉnh Khánh Hòa, hiện núi Cô Tiên chưa có quy hoạch 1/2.000. Tuy nhiên, các cấp chính quyền đã cấp quy hoạch 1/500 cho các dự án, thậm chí cấp giấy phép xây dựng. Đây là quy trình ngược, do đó nhiều công trình xây dựng trên núi Cô Tiên là bất hợp pháp. Thế nhưng không hiểu sao nhiều dự án tại đây vẫn được cấp phép và triển khai.

Trong đồ án quy hoạch chung TP.Nha Trang đến năm 2025 được Thủ tướng phê duyệt, khu đô thị phía bắc núi Sạn – nam núi Cô Tiên (P.Vĩnh Hòa và Vĩnh Hải) tổ chức trục trung tâm hướng biển có kiến trúc đa dạng, tạo điểm nhấn theo hướng thân thiện môi trường. Ngoài ra, dải đô thị dọc triền núi Hòn Sện và núi Cô Tiên có cốt nền khác nhau theo triền núi. Tuy nhiên, không hiểu vì sao hàng loạt dự án trên núi Cô Tiên vẫn được cấp phép mà chưa có đánh giá tác động môi trường một cách đàng hoàng.
Liên quan đến các dự án trên núi Cô Tiên, hồi tháng 11.2020, Thanh tra Chính phủ cũng chỉ ra 2 dự án sai phạm, đó là dự án Khu nhà ở biệt thự Incomex Sài Gòn và dự án Khu nhà ở cao cấp Hoàng Phú. Đối với dự án Khu nhà ở biệt thự Incomex Sài Gòn, Thanh tra Chính phủ xác định diện tích đất và quyết định giao đất thực hiện dự án có biểu hiện tùy tiện khi đã điều chỉnh nhiều lần về diện tích, mục đích sử dụng đất, bổ sung thêm diện tích đất lớn (16,17 ha), không phù hợp với quy hoạch xây dựng 1/500; dự án chậm tiến độ, chậm tính tiền thuê đất…
Riêng dự án Khu nhà ở cao cấp Hoàng Phú đã dính hàng loạt sai phạm trong việc giao đất, lựa chọn chủ đầu tư không qua đấu thầu, đấu giá. Tại dự án này, năm 2018 xảy ra vụ sạt lở đặc biệt nghiêm trọng khiến 4 người trong một gia đình chết thảm; hàng chục nhà dân dưới chân núi bị “xóa sổ” gần như hoàn toàn.
Cảnh báo sạt lở từ “Nha Trang Sea Park”
TP.Nha Trang vừa trải qua cơn mưa nặng hạt hồi cuối tháng 10 do ảnh hưởng áp thấp nhiệt đới (bão số 9). Đây không phải là cơn bão lớn đổ bộ trực tiếp vào TP.Nha Trang như những cơn bão có sức tàn phá khủng khiếp cách đây 2 – 3 năm. Thế nhưng, vào rạng sáng 27.10, người dân dưới chân dự án Khu biệt thự Nha Trang Sea Park (xã Phước Đồng) giật bắn người khi nghe tiếng nổ lớn từ một vụ sạt lở lúc 3 giờ sáng.
Anh Nguyễn Văn Tiến (ngụ dưới chân dự án Nha Trang Sea Park) cho hay hôm đó mưa từ chiều tối và nặng hạt, khi anh đang ngủ thì giật mình bởi tiếng nổ rất lớn làm rung chuyển cả ngôi nhà. “Tôi chạy ra ngoài thì thấy đất đá từ dự án Nha Trang Sea Park tràn xuống; một mảng tường bên trái căn biệt thự trên núi bị sạt lở biến mất. Chúng tôi ở dưới chân dự án vô cùng hoang mang vì sạt lở đất đá có thể ập vào nhà bất cứ lúc nào”, anh Tiến lo lắng.
Ghi nhận thực tế, một phần sân và tường rào của căn biệt thự 4 tầng tại dự án Nha Trang Sea Park bị sạt lở, hàng chục khối đất đá tràn xuống cạnh cổng vào dự án. Ông Bùi Cao Pháp, Phó chủ tịch UBND xã Phước Đồng, cho biết xã đã báo cáo về vụ sạt lở ở dự án Khu biệt thự Nha Trang Sea Park lên UBND TP.Nha Trang xin ý kiến chỉ đạo. “Vụ sạt lở không gây thiệt hại về người. Xã yêu cầu chủ đầu tư khẩn trương khắc phục sự cố. Dự án có vi phạm về xây dựng, xã cũng báo cáo lên UBND TP.Nha Trang đầu năm 2021”, ông Pháp thông tin.
Đáng chú ý, hồi tháng 5 vừa qua, UBND TP.Nha Trang có văn bản gửi Tỉnh ủy và UBND tỉnh Khánh Hòa về việc xử lý các công trình xây dựng tại dự án Nha Trang Sea Park. Cụ thể, thời điểm đó có 4 công trình đã xây dựng hoàn thành thì có 2 biệt thự xây vượt 1 tầng và vượt hệ số sử dụng đất, 1 biệt thự xây dựng vượt 1 tum thang. Ngoài ra còn có 2 biệt thự đang thi công là BT01-03 và BT03-14 đều xây vượt hệ số sử dụng đất. Trong đó, biệt thự BT03-14 rộng 550 m2 là biệt thự vừa bị sạt lở vào thời điểm kiểm tra đã xây dựng 3 tầng nổi và 1 tầng hầm đang trong giai đoạn hoàn thiện. Cơ quan chức năng cho rằng hệ số sử dụng đất công trình là 1,6, trong khi hệ số sử dụng đất theo quy hoạch là 1,2.
Buông lỏng công tác quản lý
Trong các địa phương tại Nha Trang “nóng” về nạn phân lô bán nền phải kể đến xã Phước Đồng, P.Vĩnh Hòa. Xã này chỉ cách TP.Nha Trang một cây cầu, diện tích rộng lại có nhiều đồi núi, nên đây là địa chỉ lý tưởng để các đối tượng “nhảy dù” phá rừng, san núi phân lô.
Tại xã Phước Đồng, sau một thời gian tạm lắng các vụ bạt núi phân lô bán nền do đang bị Thanh tra Bộ TN-MT thanh tra, mới đây hàng chục nghìn mét vuông đất rừng sản xuất nằm trên đồi núi ở thôn Phước Hạ tiếp tục bị san ủi khi chưa được cơ quan chức năng cho phép. Lãnh đạo xã này cho biết khu đất bị san gạt có nguồn gốc là đất rừng sản xuất, có diện tích hơn 1 ha. Cũng tại xã này, giai đoạn giữa năm 2020 đã xuất hiện cào núi, phân lô bán nền từ đất rừng. Có trường hợp như ông Nguyễn Đức Phán đã san ủi làm mặt bằng, đường bê tông để phân lô bán nền trên đất rừng với diện tích hơn 2,8 ha.
Tại khu vực núi Cô Tiên (P.Vĩnh Hòa, TP.Nha Trang), từ tháng 9 năm ngoái đến đầu năm nay, khu vực này xảy ra tình trạng san ủi đất rừng phân lô bán nền và xây dựng nhà trái phép. Trong đó, có trường hợp san ủi phân lô với diện tích lớn hơn 1.000 m2. Đến nay chính quyền địa phương đã có nhiều văn bản chỉ đạo, nhưng nạn san núi phân lô trái phép bán vẫn diễn ra khá công khai, như hai địa bàn kể trên.

Theo ông Nguyễn Văn Thiện, Chánh văn phòng UBND tỉnh Khánh Hòa, quan điểm chỉ đạo của tỉnh đối với việc triển khai các dự án khu vực đồi núi là phải có đầy đủ cơ sở pháp lý, đảm bảo tuân thủ quy hoạch chung của TP.Nha Trang, quy hoạch phân khu 1/2.000. Tuy nhiên, đến thời điểm này phải đợi quy hoạch điều chỉnh chung TP.Nha Trang mới có cơ sở cấp phép.
