Ngày 24/07/2022, Văn phòng Chính phủ có văn bản 217/TB-VPCP thông báo Kết luận của Thường trực Chính phủ về dự thảo Nghị quyết về tháo gỡ vướng mắc trong việc bàn giao đất quốc phòng để thực hiện Dự án Nhà ga hành khách T3 và dự án xây dựng đường giao thông kết nối với Nhà ga hành khách T3, Cảng hàng không quốc tế Tân Sơn Nhất.

Ngày 19/07/2022, tại trụ sở Chính phủ, Thủ tướng Chính phủ Phạm Minh Chính đã chủ trì cuộc họp Thường trực Chính phủ về dự thảo Nghị quyết về tháo gỡ vướng mắc trong việc bàn giao đất quốc phòng để thực hiện Dự án Nhà ga hành khách T3 và dự án xây dựng đường giao thông kết nối với Nhà ga hành khách T3, Cảng hàng không quốc tế Tân Sơn Nhất.
Thường trực Chính phủ thống nhất trình Chính phủ xem xét, ban hành Nghị quyết về tháo gỡ vướng mắc trong việc bàn giao đất quốc phòng để thực hiện Dự án Nhà ga hành khách T3 và dự án xây dựng đường giao thông kết nối với Nhà ga hành khách T3, Cảng hàng không quốc tế Tân Sơn Nhất tại cuộc họp chuyên đề về xây dựng pháp luật dự kiến tổ chức vào ngày 26/07/2022.
Giao Phó Thủ tướng Lê Văn Thành chỉ đạo xử lý mọi công việc có liên quan xây dựng Nhà ga hành khách T3, đường giao thông kết nối và 12 ụ bê tông xi măng trong phạm vi phải làm của đường lăn W11A.
Giao Bộ Quốc phòng chủ trì và các Bộ: Tư pháp, Tài nguyên và Môi trường, Tài chính, Kế hoạch và Đầu tư, Ủy ban quản lý vốn nhà nước tại doanh nghiệp, Ủy ban nhân dân Thành phố Hồ Chí Minh phối hợp chặt chẽ hoàn thiện dự thảo Nghị quyết, trình Chính phủ trước ngày 25/07/2022, đảm bảo nội dung, hồ sơ, trình tự, thủ tục tuân thủ theo đúng thẩm quyền của Chính phủ, đúng quy định của pháp luật và Quy chế làm việc của Chính phủ (ban hành kèm theo Nghị định số 39/2022/NĐ-CP ngày 18/6/2022) theo hướng:
Đồng ý chủ trương, giao Bộ Quốc phòng cập nhật, không đưa 27.94 ha đất quốc phòng vào Quy hoạch sử dụng đất quốc phòng thời kỳ 2021-2030 để thực hiện Dự án Nhà ga hành khách T3 và dự án xây dựng đường giao thông kết nối với Nhà ga hành khách T3, Cảng hàng không quốc tế Tân Sơn Nhất; Ủy ban nhân dân Thành phố Hồ Chí Minh cập nhật đưa diện tích nêu trên vào đất giao thông trong Quy hoạch Thành phố Hồ Chí Minh thời kỳ 2021-2030 và Kế hoạch sử dụng đất 5 năm (2021-2025) Thành phố Hồ Chí Minh.
Bộ Quốc phòng bàn giao các khu đất nêu trên cho Ủy ban nhân dân Thành phố Hồ Chí Minh ngay sau khi Chính phủ có Nghị quyết về tháo gỡ vướng mắc trong việc bàn giao đất quốc phòng để thực hiện Dự án Nhà ga hành khách T3 và dự án xây dựng đường giao thông kết nối với Nhà ga hành khách T3, Cảng hàng không quốc tế Tân Sơn Nhất.
Việc bồi thường tài sản trên đất theo quy định của pháp luật về đất đai (chi phí bồi thường, hỗ trợ, tái định cư được tính vào tổng mức đầu tư của các dự án), theo đó Ủy ban nhân dân Thành phố Hồ Chí Minh chịu trách nhiệm bố trí kinh phí bồi thường, hỗ trợ để thực hiện Dự án đường giao thông kết nối với Nhà ga hành khách T3, Tổng công ty cảng Hàng không Việt Nam (ACV) chịu trách nhiệm bố trí kinh phí bồi thường, hỗ trợ để thực hiện Dự án Nhà ga hành khách T3.
Về 12 ụ bê tông xi măng trong phạm vi dải lăn của đường lăn W11A thuộc Dự án cải tạo, nâng cấp đường cất hạ cánh, đường lăn Cảng hàng không quốc tế Tân Sơn Nhất: Bộ Quốc phòng, Bộ Giao thông vận tải, Tổng công ty cảng Hàng không Việt Nam (ACV) và các cơ quan liên quan chủ động thống nhất phương án giải quyết theo đúng thẩm quyền và quy định của pháp luật, đảm bảo tiến độ phá dỡ, bàn giao mặt bằng.
