Vụ án sai phạm tại SAGRI: Xét xử vắng mặt bị cáo Hồ Văn Ngon
Sáng 8.12, TAND TP.HCM tiếp tục mở phiên xét xử sơ thẩm 19 bị cáo có hành vi sai phạm tại Tổng công ty nông nghiệp Sài Gòn – SAGRI.
Sáng 8.12, TAND TP.HCM tiếp tục mở phiên xét xử sơ thẩm 19 bị cáo có hành vi sai phạm tại Tổng công ty nông nghiệp Sài Gòn – SAGRI (doanh nghiệp 100% vốn nhà nước, do UBND TP.HCM là chủ sở hữu), gây thiệt hại cho nhà nước hơn 672 tỉ đồng.
Trong đó có các bị cáo: Lê Tấn Hùng (58 tuổi, cựu Tổng giám đốc Tổng công ty nông nghiệp Sài Gòn – SAGRI), Trần Vĩnh Tuyến (56 tuổi, cựu Phó chủ tịch UBND TP.HCM), Trần Trọng Tuấn (cựu Giám đốc Sở Xây dựng TP.HCM).

Trước đó, vào sáng 6.12, HĐXX đã tạm dừng phiên tòa để xác minh một số vấn đề. Phía luật sư của bị cáo Hồ Văn Ngon (nguyên Phó tổng giám đốc SAGRI) trình bày, bị cáo Ngon có đơn xin hoãn phiên tòa do đang điều trị bệnh. Ngoài ra, bị cáo Nguyễn Thị Tuyết Mai (nguyên Trưởng phòng Nhân sự hành chính SAGRI) có đơn xin xét xử vắng mặt vì bị cáo đang là F1, cách ly tại nhà. Đại diện Viện KSND TP.HCM đề nghị HĐXX xem xét cho bị cáo Mai, bởi lời khai của bị cáo đã có trong hồ sơ vụ án.
Về vấn đề này, tại phiên tòa sáng nay (8.12), HĐXX đã thông báo kết quả xác minh. Tòa đã xác minh với bác sĩ điều trị của bị cáo Ngon, bác sĩ này xác định điều kiện sức khỏe của bị cáo đủ điều kiện để tham gia phiên tòa. Tuy nhiên, bị cáo Ngon đã có đơn xin xét xử vắng mặt.
HĐXX quyết định tiếp tục xét xử vụ án, vắng mặt hai bị cáo Hồ Văn Ngon và Nguyễn Thị Tuyết Mai.
Theo cáo trạng, UBND TP.HCM giao khu đất thuộc sở hữu nhà nước có diện tích hơn 36.676 m2 tại KP.4, P.Phước Long B, Q.9 (nay là TP.Thủ Đức, TP.HCM) cho SAGRI thực hiện dự án nhà ở. Năm 2008, SAGRI ký hợp đồng hợp tác kinh doanh với Tổng công ty Phong Phú để cùng hợp tác kinh doanh đầu tư dự án.
Năm 2015, bị cáo Lê Tấn Hùng biết dự án khu nhà ở tại KP.4, P.Phước Long B, Q.9 chưa đủ điều kiện để chuyển nhượng, nhưng vẫn chỉ đạo cấp dưới hoàn thiện thủ tục, ký văn bản đề nghị UBND TP.HCM chấp thuận để chuyển nhượng toàn bộ dự án cho Tổng công ty Phong Phú với giá hơn 168 tỉ đồng.
Bên cạnh đó, quá trình chuyển nhượng, dự án không được thẩm định giá theo giá thị trường, không tiến hành đấu giá. Các bên tự thỏa thuận giá trị dự án và thực hiện các thủ tục chuyển nhượng, trái với quy định pháp luật gây thiệt hại thất thoát cho ngân sách nhà nước hơn 672 tỉ đồng.
Ngoài hành vi nêu trên, năm 2016, bị cáo Hùng chỉ đạo cấp dưới lập khống 10 hồ sơ, hợp đồng cho cán bộ, nhân viên SAGRI đi tham quan, học tập kinh nghiệm tại nước ngoài, chiếm đoạt hơn 13,3 tỉ đồng của SAGRI để sử dụng vào mục đích cá nhân. Quá trình điều tra, toàn bộ số tiền tham ô này đã được các bị can liên quan khắc phục hậu quả.
Với vai trò là Phó chủ tịch UBND TP.HCM, bị cáo Trần Vĩnh Tuyến đã ký quyết định chấp thuận chuyển nhượng dự án phát triển khu nhà ở tại KP.4, P.Phước Long B do SAGRI làm chủ đầu tư cho Tổng công ty Phong Phú. Các bị cáo là cán bộ, lãnh đạo tại UBND TP.HCM, Sở Xây dựng… biết việc SAGRI chuyển nhượng dự án cho Tổng công ty Phong Phú là trái quy định nhưng vẫn tham mưu, ký chấp thuận.
Cáo trạng vụ án sai phạm tại SAGRI cũng nêu, việc các bị cáo tiến hành, cho phép chuyển nhượng dự án của SAGRI trái quy định, không yêu cầu định giá dự án để tiến hành đấu giá, là nguyên nhân chính gây hậu quả thiệt hại, thất thoát đặc biệt lớn cho nhà nước.
